Right of Victims

The Investigating Officer shall furnish the description of the rights of victim(s) of road accidents and flow chart of the Scheme mentioned in Form II, to the victim(s), or their legal representatives, within ten (10) days of the accident.

Rights of victims of Road Accidents

Right to immediate medical aid and treatment.
Right to copy of FIR.
Right to copy of First Accident Report (Form-I).
Right to copy of Rights of Victim and Flow Chart of this Scheme(Form-II).
Right to copy of Driver's Form-III along with the documents.
Right to copy of Owner's Form-IV along with the documents.
Right to copy of Interim Accident Report (IAR) in Form-V along with the documents.
Right to blank copy of format of Victim's Form-VI and Form-VIA.
Right to copy of Detailed Accident Report (DAR) in Form-VII along with the documents.
Right to copy of Insurance Form-IX.
Right to copy of Report under Section 173 of Cr.P.C.
Right to copy of Victim Impact Form in Form-XII.

Right to copy of MLC and Post-Mortem Report.
Right to free legal aid from State Legal Services Authority.
Right of a minor child/children (18 years or below) of the victim to be referred to the Child Welfare Committee by the IO for enquiry into their needs and status.
Right of a minor child/children (18 years or below) of the victim to have the Child Welfare Committee conduct an Inquiry through the District Child Protection Officer into their well-being, medical needs, security, nutrition etc.
Right of a minor child/children (18 years or below) of the victim to get all benefits of Juvenile Justice (Care and Protection of Children) Act, 2015 in case the Child Welfare Committee returns a finding of a child being a Child in Need of Care and Protection (CNCP).
Right of such minor child/children of the Victim to be placed in a Children's Home in case both the parents died or the surviving parent is unable to take care of the child, as provided under the Juvenile Justice (Care and Protection of Children) Act, 2015.
Right to receive compensation under the Scheme for Motor Accident Claims formulated by the Delhi High Court.

Following documents should accompany the petition

Copy of the FIR registered in connection with said accident, if any.
Copy of the MLC/Post Mortem Report/Death Report as the case may be.
The documents of the identity of the claimants and of the deceased in a death case.
Original bills of expenses incurred on the treatment alongwith treatment record.
Documents of the educational qualifications of the deceased, if any.

Disability Certificate, if already obtained, in an injury case.
The proof of income of the deceased/injured.
Documents about the age of the victim.
The cover note of the third party insurance policy, if any.
An affidavit detailing the relationship of the claimants with the deceased.

The main objective of the Motor Accident Claim Tribunal (MACT) is to resolve the cases of motor accidents. Whether it is a bike accident, car accident or truck accident, every accident case is resolved under this tribunal. The MACT has the power to conduct hearings, resolve claims and award compensation to the victim.

The insurer is the person or company who has to pay or award the compensation amount to the victim (who lost his/her life in that accident) or their legal heir.

DAR stands for Detailed Accident Report. It is a comprehensive document that contains all the relevant information and facts about the accident.
